2. Entry into Force
These Terms & Conditions are effective from [1 September 2026] and take precedence over all previous oral or written terms and conditions.
These Terms & Conditions apply to all Reservations confirmed on or after the effective date. Reservations confirmed before this date remain governed by the version of these Terms & Conditions in force at the time of confirmation, subject to Section 19.
Nothing in these Terms & Conditions limits any consumer protection rights you hold under the mandatory legislation of your country of residence.
3. Scope
These Terms & Conditions apply to the Personal Vintage Experience offered by HATT et SÖNER and purchased by Members for private enjoyment.
By paying the Reservation Fee, the Member accepts these Terms & Conditions and confirms that:
He or she is of legal drinking and purchasing age in the Member’s country of residence (minimum 18 years); He or she has read and understood the HATT et SÖNER Privacy Policy, available at www.hatt-soner.com/privacy.
The Personal Vintage Experience is offered for the Member’s private enjoyment. The Member shall not use the HATT et SÖNER name, trademarks, logos, or marketing materials in connection with any commercial resale of the Reserved Bottles without HATT et SÖNER’s prior written consent.
4. Right of Withdrawal and Cancellation
4.1 Statutory withdrawal period
The Member has a right to withdraw from the Reservation within 14 days of paying the Reservation Fee, by written notice to pv@hatt-soner.com. HATT et SÖNER will refund the Reservation Fee in full within 14 days of receiving the withdrawal notice.
4.2 No cancellation after withdrawal period
After the 14-day withdrawal period, the Reservation is firm and final. The Member acknowledges that:
(a) The Personal Vintage Experience is a bespoke service produced to the Member’s personal specifications, including the Member’s selection of grape origin, vinification method, ageing method, bottle format, dosage, and labelling; (b) Production begins shortly after Reservation confirmation, with grape juice allocated, pressed, and committed to the Member’s specifications; (c) The Reserved Bottles cannot be reallocated, resold to other customers, or returned to general inventory; (d) The Personal Vintage Experience is a multi-year commitment of approximately four years from Reservation to delivery; and (e) For these reasons, and in accordance with Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply after the 14-day period.
4.3 No refund after withdrawal period
The Reservation Fee is non-refundable after the 14-day withdrawal period, except in the specific circumstances set out in these Terms & Conditions:
Section 9 (harvest postponed for two or more consecutive years); Section 10 (force majeure exceeding 12 months); Section 11 (loss or damage during storage, pro rata); Section 13 (cancellation by HATT et SÖNER for breach of Core Values); Section 19.2 (Member declines a material amendment, pro rata for services not yet delivered).
4.4 Member-initiated cancellation in exceptional circumstances
HATT et SÖNER may, at its sole discretion and in good faith, agree to cancel a Reservation outside the 14-day window in exceptional personal circumstances such as serious illness or bereavement. Any refund in such cases will reflect costs already incurred in production, storage, and administration, and is not a matter of right.
5. The Process and Services
The production process, available options, and current pricing are detailed on the HATT et SÖNER website at www.hatt-soner.com/pv-process. A summary follows below.
5.1 Tasting and Selection
The Member selects the origin of the grape juice, the vinification method (oak barrel or steel tank), the ageing method (crown capsule or natural cork), and the bottle format. Available formats include 0.75L, 1.5L (Magnum), 3L (Jeroboam), and 6L (Mathusalem).
The minimum reservation quantity is 60 bottles (0.75L equivalent). The process, decisions, and current costs are set out on the HATT et SÖNER website.
5.2 Pressing and First Fermentation
HATT et SÖNER ensures that only the first pressing of the grapes is used for all Members. The grape juice is placed in steel tanks or oak barrels according to the Member’s reservation.
The winemaker determines the total storage time based on professional winemaking judgement and the characteristics of the vintage. Indicative durations are six months in steel tanks and three to six months in oak barrels, but actual durations may vary.
5.3 Bottling and Storage
The winemaker decides when bottling takes place, typically between six and twelve months from harvest. The fermented grape juice is bottled in the Member’s chosen format unless otherwise agreed in writing.
HATT et SÖNER ensures that:
The Reserved Bottles are stored in optimum conditions in a Personal Vintage Storage case, personalised with the Member’s name plaque and serial number; The Reserved Bottles are uniquely identifiable and kept separate from all other products.
The Reserved Bottles are stored on the lees for a minimum period determined by the winemaker, followed by a minimum of three months ageing after disgorgement. The total minimum Storage Period from bottling to delivery readiness is three years. This Storage Period is included in the Reservation Fee.
5.4 Extended Storage
Non-disgorged bottles. After the initial three-year Storage Period, the Member may extend storage on the lees in increments of one year. HATT et SÖNER will contact the Member at least three months before the end of each Storage Period to confirm whether the Member wishes to disgorge or continue storage.
If the Member does not respond within 30 days of the first notice, HATT et SÖNER will send a second written reminder. If the Member does not respond within 30 days of the second reminder, storage will be extended by one additional year at the applicable rate. Auto-extension applies for a maximum of three consecutive cycles, after which active written confirmation from the Member is required.
Disgorged bottles awaiting delivery. Disgorged bottles that remain uncollected more than three months after disgorgement will be subject to a finished-bottle storage fee at the applicable rate. HATT et SÖNER will notify the Member of this fee in advance.
Current storage rates are available at www.hatt-soner.com/pv-process or by contacting pv@hatt-soner.com.
5.5 Disgorgement and Dosage
A Disgorgement Campaign runs every year from May to December and is available to the Member from the fourth year after harvest. The Member may also elect to defer disgorgement to a later year, subject to Section 5.4.
The Member’s reservation includes one level of dosage per disgorgement. HATT et SÖNER offers two options: the winemaker’s recommendation or the Member’s own choice.
HATT et SÖNER will notify the Member by email at least three months before the Disgorgement Campaign.
5.6 Labelling and Personalisation
The Reservation Fee includes personalisation of the back label with the Member’s logo or image. Personalisation of the front label with the Member’s initials is not included and is charged separately. Labelling is carried out at the time of disgorgement and dosage. The Member should submit labelling preferences together with the dosage decision.
For current labelling options and the submission process, contact pv@hatt-soner.com.
The Member is responsible for ensuring that any submitted design does not infringe third-party intellectual property rights or applicable laws. HATT et SÖNER reserves the right to reject any design that it reasonably considers to be infringing, offensive, or non-compliant. The Member shall indemnify HATT et SÖNER against any direct claims, damages, and reasonable legal costs arising from the Member’s label content, to the extent caused by the Member’s content.
By submitting label content, the Member grants HATT et SÖNER a non-exclusive, royalty-free licence to reproduce that content solely for the purposes of producing, labelling, and storing the Reserved Bottles. HATT et SÖNER will not use the Member’s label content for marketing or other purposes without the Member’s prior written consent.
HATT et SÖNER will include all information required by French and EU champagne regulation on every label.
5.7 Family Reserve
The Family Reserve is an annual allocation programme available to Personal Vintage Members. Membership begins upon the Member’s Family Reserve Enrolment. By joining the Family Reserve, the Member commits to a recurring annual allocation of bottles produced to the Member’s Personal Vintage recipe (grape origin, vinification method, ageing method, bottle format) for each successive vintage. The Member’s recipe is preserved in HATT et SÖNER’s archives for as long as the membership remains active.
Each year, HATT et SÖNER will send the Member the invoice for that year’s Family Reserve allocation, stating the harvest year, quantity, and applicable price.
Should the Member not wish to receive that year’s allocation, the Member shall notify HATT et SÖNER in writing within twenty (20) days of the date of the allocation invoice. HATT et SÖNER will then cancel that year’s allocation with no further obligation on the Member. The Family Reserve membership remains active, the Member’s recipe continues to be preserved, and the Member will be invited to the following year’s allocation, unless the Member asks to end the Family Reserve membership altogether.
If HATT et SÖNER does not receive such notice within the 20-day period, the allocation is confirmed and production will continue as planned. Payment of the allocation invoice is due in accordance with Section 8; non-payment of a confirmed allocation is governed by the reminder and cancellation process set out in Section 6.
Each confirmed annual allocation constitutes a separate Reservation governed by these Terms & Conditions, including, for Consumer Members, the right of withdrawal under Section 4.1. No separate Reservation Form is required for Family Reserve allocations; the Reservation is created by the Member’s Family Reserve Enrolment and confirmed in accordance with this Section 5.7, and references in these Terms & Conditions to the Reservation Form shall be read, for Family Reserve allocations, as references to the Family Reserve Enrolment together with the annual allocation invoice.
The Member may amend the recipe or quantity for any future vintage, or end the Family Reserve membership at any time by written notice with effect for future vintages. Ending the membership does not affect allocations already confirmed.
The Family Reserve remains subject to Section 9 (harvest quality) and to HATT et SÖNER’s right to decide allocation in good faith based on production capacity.
5.8 Experiences and Events
HATT et SÖNER offers a programme of experiences connected to the Personal Vintage. The current programme of complimentary and paid events is available at www.hatt-soner.com/blogs/events.
HATT et SÖNER reserves the right to modify the events programme or cancel specific events. For paid events, HATT et SÖNER will provide reasonable notice and a full refund of any fees paid. For complimentary events, HATT et SÖNER will use reasonable efforts to offer an alternative date.
6. The Reservation Process
The reservation process begins with a tasting (see Section 5.1) and is formalised by signing a Reservation Form. For Family Reserve allocations, the reservation process is as set out in Section 5.7.
HATT et SÖNER reserves the right to decide, in good faith and based on production capacity and availability, whether to accept a Reservation and the size of any allocation. If HATT et SÖNER offers an allocation smaller than the Member’s requested quantity, the Member may either accept the reduced allocation or decline the Reservation in full with a refund of any sums paid.
Upon acceptance, HATT et SÖNER issues the Reservation confirmation invoice (the first invoice for the pre-ordered bottles, excluding VAT). Payment of this invoice constitutes the Reservation Fee and confirms the Member’s acceptance of these Terms & Conditions.
The Reservation Fee shall be paid within 20 days of the Reservation confirmation invoice in accordance with Section 8. If payment is not received within this period, HATT et SÖNER will send a written reminder. If payment is still not received after a further 30 days, HATT et SÖNER may cancel the Reservation and reallocate the production capacity. Any future allocation remains subject to availability.
The 14-day statutory withdrawal right under Section 4.1 runs from the date of payment of the Reservation Fee.
It is the Member’s responsibility to ensure that HATT et SÖNER has correct and current contact information at all times. Changes must be communicated to pv@hatt-soner.com.
7. Delivery
The Reserved Bottles will be ready for delivery no later than three months after disgorgement.
HATT et SÖNER will inform the Member when the Reservation is ready for delivery. The Member shall then provide a Confirmation for Delivery in writing without undue delay.
Upon receipt of the Confirmation for Delivery, HATT et SÖNER will issue the final invoice including VAT, applicable transport and insurance costs, and any additional fees (such as extended storage). The delivery charges will include transport, insurance, alcohol duties, and the VAT applicable in the country of delivery, in accordance with the regulations in force at the time of delivery.
7.1 Delivery terms
Unless the Member elects ex-cellar collection in writing, HATT et SÖNER will arrange transport, insurance, and customs clearance to the Member’s designated delivery address (Delivered Duty Paid, Incoterms 2020). Transport, insurance, alcohol duties, and applicable VAT are invoiced to the Member at cost on the final invoice. Risk transfers to the Member upon delivery to the designated address.
Where the Member elects ex-cellar collection, the price is quoted on an ex-cellar basis (Incoterms 2020 Ex Works) from HATT et SÖNER’s bonded warehouse, and the Member is responsible for collection, export formalities, and onward transportation. Risk transfers to the Member upon collection.
For specific delivery arrangements, enquire at pv@hatt-soner.com.
7.2 Non-payment after delivery confirmation
All outstanding amounts must be settled before delivery can take place. If the final invoice is not settled within six months from its due date despite written reminders, HATT et SÖNER will:
Send a final written notice by registered post with acknowledgement of receipt, expressly stating that failure to pay within 30 days will result in cancellation of the Reservation and disposal of the Reserved Bottles, and that the Reservation Fee will be retained; If payment is still not received, cancel the Reservation and dispose of the Reserved Bottles.
Disposal under this section means, at HATT et SÖNER’s discretion, destruction of the bottles or removal of all personalisation and reallocation to general inventory.
In case of cancellation under this section, the Reservation Fee is non-refundable and shall be retained by HATT et SÖNER to cover the substantial costs incurred in the bespoke production, storage, and administration of the Reserved Bottles.
8. Prices and Payment
Current prices are published at www.hatt-soner.com/pv-process and are confirmed in the Reservation confirmation invoice. Prices applicable to a confirmed Reservation are those stated in the confirmation and are not subject to subsequent price changes.
Prices are stated in Euros. Local taxes and import duties may apply depending on the Member’s country of residence.
The Member shall pay all invoices within twenty (20) days of the invoice date by wire transfer, credit card, or any other method agreed in writing with HATT et SÖNER.
Late payment — Corporate Members. Late payment interest will be charged at the rate provided by Article L.441-10 of the French Code de commerce (currently the ECB refinancing rate plus 10 percentage points), together with a fixed recovery fee of €40 as permitted by law.
Late payment — Consumer Members. Late payment interest will be charged at the legal interest rate under Article L.313-2 of the French Code monétaire et financier from the date payment falls due.
9. Harvest Quality
The winemaker determines whether each year’s harvest meets the quality standard required for the PVE. If the harvest is insufficient, the Member’s Reservation is postponed to the following year and HATT et SÖNER will inform the Member without delay.
If the Reservation is postponed for two or more consecutive years, the Member may cancel the Reservation by written notice and receive a full refund of the Reservation Fee. If the Member does not cancel, the Reservation Fee remains held and applied to the next available vintage.
10. Force Majeure
If HATT et SÖNER’s performance is prevented or significantly hindered by force majeure, HATT et SÖNER is released from its obligations for the duration of the hindrance. Force majeure includes war, fire, pandemic, abnormal weather conditions, floods, government restrictions, and other comparable circumstances beyond HATT et SÖNER’s reasonable control.
The party invoking force majeure shall notify the other party in writing without undue delay, describing the nature of the event and its expected duration.
If force majeure continues for more than twelve (12) months, either party may terminate the agreement by written notice. In such case, HATT et SÖNER will refund the Reservation Fee on a pro rata basis for services not yet delivered.
11. Unforeseen Events Related to Storage
If Reserved Bottles are lost or damaged during storage, HATT et SÖNER will, at its option:
(i) replace the bottles with the next available vintage at no additional cost to the Member; or (ii) refund the Member the value of the lost bottles calculated at the then-current published price for equivalent Personal Vintage bottles.
HATT et SÖNER’s liability under this section does not extend to indirect or consequential damages.
12. Insurance
HATT et SÖNER maintains insurance with a reputable insurer covering the grape juice and Reserved Bottles for their full replacement value from the date of Reservation until delivery in accordance with Section 7. Where HATT et SÖNER arranges transport (DDP), insurance coverage extends to the point of delivery. A summary of cover is available on request.
13. Core Values
HATT et SÖNER Personal Vintage brings together people from around the world who share a passion for champagne and the art of its production. Respect for each other and for the HATT et SÖNER community is fundamental.
In the exceptional case that a Member or their guest engages in material conduct that is abusive, harassing, deliberately damaging to HATT et SÖNER property, or otherwise seriously incompatible with these values, HATT et SÖNER may, after providing written notice and a reasonable opportunity to respond, deny access to specific events. In cases of repeated or particularly serious conduct, HATT et SÖNER may cancel the Reservation with a refund of all sums paid by the Member (including the Reservation Fee and any storage fees). Any cancellation under this section shall be proportionate to the conduct in question.
14. Lost Contact
The Member is responsible for ensuring that HATT et SÖNER holds up-to-date contact details at all times.
If HATT et SÖNER is unable to contact the Member at the end of the Storage Period (including any extensions), HATT et SÖNER will make documented efforts to reach the Member via email, postal mail, and telephone over a period of twelve (12) months. If the Member remains unreachable after this period, the Reservation will be considered cancelled and HATT et SÖNER may dispose of the Reserved Bottles in accordance with Section 7.2.
Sums paid by the Member that exceed costs reasonably incurred by HATT et SÖNER (production, storage, administration, disposal) will be held for a further period of three years in case the Member resurfaces, after which they will be retained by HATT et SÖNER.
15. Intellectual Property
HATT et SÖNER retains all intellectual property rights in the HATT et SÖNER name, trademarks, logos, and any other intellectual property owned or registered by HATT et SÖNER. The Member’s right to personalise labels does not imply any assignment or transfer of these rights.
By submitting label content, the Member grants HATT et SÖNER the licence set out in Section 5.6.
16. Personal Data
HATT et SÖNER processes personal data to deliver the Personal Vintage Experience under Article 6(1)(b) of the GDPR (contract performance) and, where applicable, Article 6(1)(f) (legitimate interests in customer relationship management) and Article 6(1)(a) (consent, for marketing communications).
Categories of data processed, retention periods, recipients, and Member rights (including access, rectification, erasure, portability, and objection) are set out in the HATT et SÖNER Privacy Policy at www.hatt-soner.com/privacy.
To exercise data rights or for any data-related enquiry, contact pv@hatt-soner.com. To lodge a complaint, contact the Commission nationale de l’informatique et des libertés (CNIL) at www.cnil.fr.
17. Limitation of Liability
HATT et SÖNER is not liable for defects or damages caused by the Member’s own transportation, storage, or handling of the Reserved Bottles after delivery, or that result from use not appropriate for champagne.
HATT et SÖNER is not liable for dissatisfaction attributable to the Member’s own production choices (vineyard, vinification, dosage, ageing), provided HATT et SÖNER supplied accurate information to support those choices.
Where HATT et SÖNER arranges transport under DDP terms, HATT et SÖNER is responsible for defects or damage occurring during that transport.
Subject to the matters that cannot be excluded by law (including hidden defects under Articles 1641–1649 of the French Civil Code, gross negligence, and wilful misconduct), HATT et SÖNER’s total aggregate liability to the Member under or in connection with the Reservation shall not exceed the total sums paid by the Member to HATT et SÖNER under that Reservation.
Nothing in these Terms & Conditions excludes or limits liability for hidden defects (vices cachés) under Articles 1641–1649 of the French Civil Code, or any other liability that cannot be excluded by law.
18. Complaints
Any complaint regarding the Reserved Bottles must be submitted in writing to pv@hatt-soner.com:
Visible defects: within 30 days of delivery; Hidden defects: within a reasonable time of discovery, and no later than two years from delivery.
Complaints should include the Member’s name and Reservation number, a description of the defect, and photographs where possible. HATT et SÖNER will respond within 15 business days. Available remedies include replacement, credit, or refund at HATT et SÖNER’s reasonable discretion.
If the Member is not satisfied with HATT et SÖNER’s response, the Member may refer the matter to the Médiateur de la consommation du secteur des vins et spiritueux before pursuing any legal remedy. Members resident in the European Union may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
19. Amendments
HATT et SÖNER may amend these Terms & Conditions from time to time. Members will be notified of any changes by email at least 30 days before the amendments take effect.
19.1 Non-material changes
Non-material changes (corrections, clarifications, updates to contact details, changes to the events programme, and similar adjustments that do not materially affect the Member’s rights or obligations) take effect automatically at the end of the 30-day notice period and apply to all existing Reservations.
19.2 Material changes
Material changes are changes to pricing structure for services not yet invoiced, liability, delivery terms, cancellation rights, intellectual property, governing law, or any other change that materially affects the Member’s rights or obligations.
For existing Reservations, material changes do not apply automatically. The Member’s Reservation will continue to be governed by the version of these Terms & Conditions in force at the time of the Reservation confirmation invoice, unless the Member expressly accepts the new version in writing.
For Reservations confirmed after the effective date of an amendment, the new version applies in full.
19.3 Locked terms
For the avoidance of doubt, prices for bottles already confirmed under Section 8 are not subject to amendment. Storage fees, disgorgement fees, labelling fees, and other variable charges are subject to the rates published at the time the relevant service is rendered.
20. Succession and Assignment
The Reservation is personal to the Member and may not be assigned without HATT et SÖNER’s prior written consent (such consent not to be unreasonably withheld for transfers to the Member’s spouse, descendants, or family trust).
On the death of a Consumer Member, the Reservation passes to the Member’s estate, which may:
(i) take delivery in accordance with these Terms & Conditions; (ii) assign the Reservation to a beneficiary with HATT et SÖNER’s consent; or (iii) cancel the Reservation with a refund of sums paid less costs reasonably incurred by HATT et SÖNER in production, storage, and administration.
21. Anti-Bribery and Sanctions
The Member warrants that:
(a) The Member is not subject to any international sanctions imposed by the United Nations, European Union, France, the United Kingdom, or the United States; and (b) The funds used to pay the Reservation Fee and any other sums under these Terms & Conditions are derived from lawful sources.
HATT et SÖNER may suspend or cancel the Reservation if it reasonably determines that performance would breach applicable sanctions or anti-money-laundering laws. In such case, HATT et SÖNER will refund any sums received that may lawfully be returned.
22. Confidentiality
HATT et SÖNER will not disclose the Member’s identity or the existence of the Member’s Reservation to third parties without the Member’s consent, except as required by law or to service providers bound by confidentiality obligations.
23. General Provisions
23.1 Severability
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.
23.2 Entire agreement
These Terms & Conditions, together with the Reservation Form (or, for Family Reserve allocations, the Family Reserve Enrolment and the annual allocation invoice) and the documents they refer to, constitute the entire agreement between the parties and supersede all prior representations, agreements, and understandings.
23.3 No waiver
Any failure or delay by HATT et SÖNER in exercising any right under these Terms & Conditions does not constitute a waiver of that right.
24. Governing Law and Disputes
These Terms & Conditions are governed by French law.
Disputes that cannot be resolved amicably shall be referred to the competent courts in Reims, France. If the Member is a Consumer Member resident in the European Union, the Member may also bring proceedings in the courts of the Member’s country of residence, refer the dispute to the relevant consumer ombudsman, or use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
25. Language
These Terms & Conditions are drawn up in English and French. In the event of any conflict between the two versions, the French version prevails for matters of French law; the English version prevails for all other matters.
