TERMS AND CONDITIONS OF USE

 

1. GENERAL

1.1 General information regarding HATT et SÖNER and our products
HATT et SÖNER International SAS (hereinafter referred to as "HATT et SÖNER"), with corporate number 798 272 993 00014, is a company with its registered office in Bergères-les-Vertus, France. The company markets and distributes champagne to restaurants, corporate clients or private individuals (hereinafter referred to as "customers) in France and abroad under the brand HATT et SÖNER.  

Champagne contains alcohol. Excessive alcohol consumption can be harmful.

1.2 About the Terms and Conditions
The valid terms and conditions are the ones currently on the website and shall take precedence over all previous oral or written terms and conditions. The terms and conditions apply to the purchase and delivery of products offered by HATT et SÖNER on the website hatt-soner.com. By purchasing HATT et SÖNER’s products, the customer accepts to be bound by the then-current version of the purchase conditions.

These Terms and Conditions shall not limit any mandatory regulation according to the Swedish Consumer Sales Act (Swe: Konsumentköplagen 2022:260).

If these conditions are amended, the customers will be informed about the changes in writing by e-mail. 

1.3 General information on being a customer at HATT et SÖNER

The customer accepts HATT et SÖNER's general terms and conditions when the customer places an order. The customer guarantees that he or she is at least 20 years old, required under the Swedish Alcohol Act (Swe: Alkohollag (2010:1622), to purchase champagne. The customer also confirms that he or she has read and understood HATT et SÖNER's privacy policy (see below article 1.4), which describes the processing of personal data.

It is the customer's responsibility to assure that HATT et SÖNER always has the customer's updated contact details. In the case that the customer changes their contact details, the customer must notify HATT et SÖNER without delay by e-mail to orders@hatt-soner.com.


1.4 GDPR and the processing of personal data
HATT et SÖNER ensures that the personal data provided to HATT et SÖNER by the customer is stored and processed in a safe and secure manner and in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Swedish Data Protection Act (Swe: Lag (2018:218) med kompletterande bestämmelser till EU:s dataskyddsförordning). 2. Placing an order

2.1 Age limit
The customer guarantees that he or she is of 20 years of age when purchasing champagne, as required by the Swedish Alcohol Act (Swe: Alkohollag (2010:1622)). HATT et SÖNER reserves the right to refuse to deliver the product to the customer if it is suspected that he or she is under the legal age.


2.2 How to place an order
The placing of an order is made through the website hatt-soner.com under the section "E-commerce". The customer adds the desired products to the shopping cart by clicking on the product and then "Add to cart". Once the customer has placed the desired products in the shopping cart, the customer continues the ordering process by clicking on the cart symbol on the top right corner and then "Checkout". On the checkout page, the customer should provide their contact details, payment details and delivery address. The payment is then processed through the e-commerce platform Shopify. An order confirmation will be sent to the e-mail address provided by the customer once the order has been processed.

It is the customer's responsibility to ensure that HATT et SÖNER always has the correct contact information from the placing of the order to the final delivery.


2.3 Product availability
All products are subject to availability. In the case that the product is not in stock when the customer places their order, HATT et SÖNER will notify the customer to decide upon a late delivery date or a refund of the total amount of the order. The reimbursement will be done using the original method of payment.


2.4 Cancellation
If the customer cancels the order before delivery, HATT et SÖNER is entitled to claim compensation under the Swedish Consumer Sales Act (Swe: Konsumentköplagen 2022:160) for the costs incurred in connection with the cancellation. This includes, among other things, special costs incurred in entering and concluding the contract, special costs resulting from the cancellation, administrative costs, or costs incurred as a result of the cancellation.

 

3. DELIVERY

3.1 Delivery, delivery time, and delivery conditions
After receiving the order, HATT et SÖNER will send an order confirmation to the customer's e-mail address including the delivery time and a tracking link to the order. Estimated delivery time is normally 10 days after the completed purchase but may vary depending on where in the country the customer lives. The customer pays for the shipping and postage. The price of the shipping is calculated when placing the order and can vary depending on the quantity of products ordered and/or the purchased amount.

If the delivery cannot be carried out because the customer is not present at the time of delivery, or cannot identify himself/herself in accordance with article 2.1 or for any other reason that is attributable to the customer, the customer shall be liable for reimbursement for the new delivery or any other incurred costs. This includes the storage of the products until the delivery can be completed and additional costs for all the new delivery attempts charged by the carrier. The customer shall contact the carrier without delay to schedule a new delivery according to the carrier’s availability. HATT et SÖNER reserves the right to return the products to France if the delivery cannot be completed or if the customer does not contact the carrier or HATT et SÖNER within 10 days after the first initial delivery time. The return will then be paid by the customer. 

It is the customer's responsibility to check the contents of the package upon delivery and to make any reservations either on the delivery note provided by the carrier, on the carrier's electronic box or by immediately calling the carrier's customer service in the presence of the person who delivered the parcel. The customer should also notify HATT et SÖNER without delay by e-mail to order@hatt-soner.com. If all the above conditions are met, HATT et SÖNER undertakes to offer the customer a redelivery or a full or partial refund.

4. PAYMENT

4.1 Prices and price list
All prices on the HATT et SÖNER website include, in addition to the price of the goods, VAT and alcohol tax.

5. GUARANTEES

HATT et SÖNER guarantees that the products sold on the website are of high quality. The quality of the products is determined through regular checks to ensure a good wine quality.

The images of the products on HATT et SÖNER’s website are for illustrative purposes only. Although HATT et SÖNER have made every effort to display the colors accurately, HATT et SÖNER cannot guarantee that the customer’s computer's display of the colors accurately reflects the color of the products. The customer’s products may therefore slightly vary from those images. The packaging of the products may also vary from that shown on images on HATT et SÖNERs website.

 

6. RIGHT OF WITHDRAWAL

If the customer is not satisfied with the product or for any other reasons wants to cancel the order, the customer has a 14-day right of withdrawal in accordance with the Swedish Distance Contracts Act (Swe: Lag (2005:59) om distansavtal och avtal utanför affärslokaler) from the day the customer received the product. The products must be returned in their original condition and in the unopened original packaging.

To return the products, the customer should contact HATT et SÖNER by phone or e-mail to orders@hatt-soner.com. The customer must provide their name, address, and order number.

The customer pays the shipping costs for the return. The product must be sent back within 14 days from the date the customer notified the return.

The refund will be made using the same payment option that the customer chose when placing the order. HATT et SÖNER reserves the right to deduct an amount from the refund amount for depreciation if the customer has handled the product to a greater extent. 

7. RECLAMATION

If a product ordered by the customer has major faults or a faulty taste, the customer has the right to reclamation of the product (in accordance with the Consumer Sales Act (Swe: Konsumentköplagen 2022:260). Reclamation of the product should be sent to orders@hatt-soner.com indicating the fault and the order number. The customer then has 60 days from the date of purchase to send back the faulty bottles with their corks and with at least 75% of their content. The bottles will be examined and judged by HATT et SÖNER and if the same fault can be stated, HATT et SÖNER will replace the bottle or offer a voucher of the same amount of the price of the product.

 

8. LIMITATION OF LIABILITY 

8.1 Damage and defects
HATT et SÖNER is responsible for damages caused by transport, storage or other manipulation. HATT et SÖNER is not responsible for defects or damages caused by the customer.


8.2 Force majeure
If the performance of HATT et SÖNER's obligations under these terms and conditions is hindered or significantly impeded as a result of force majeure, HATT et SÖNER shall be exempted from its obligations to the customer for the period during which the hindrance lasts. Furthermore, the customer shall not be entitled to compensation for any loss or damage that may arise as a result of such force majeure. The term force majeure includes, but is not limited to, war, other disruptions for those responsible for production or delivery, accidents, deaths, fires, pandemic diseases, abnormal weather conditions, floods or other comparable circumstances beyond the control of HATT et SÖNER. 

 

9. APPLICABLE LAW

These terms and conditions are governed by the Swedish law.

In the event of any dispute or claim arising out of or in connection with these terms and conditions which cannot be settled amicably, the competent courts of Reims, France, shall have exclusive jurisdiction. If the customer is a resident of the European Union, the customer has the right to bring the matter before a court in the place where the customer resides. The customer also has the right to refer the dispute to the appropriate consumer ombudsman.
